Hyderabad, June 29: In a major reprieve for Governor of Tamil Nadu K.Rosaiah, the High Court of Andhra Pradesh Friday personnel exempted him from appearing in a city court in a case of land allocation.
The high court in a petition filed by Rosaiah, stayed the summons issued by a lower court in a case involving de-notification of government land when he was chief minister of Andhra Pradesh.The Anti-Corruption Bureau (ACB) Track June 18 Rosaiah had directed to appear before the Aug. 2.
Rosaiah Government of July 15, 2010 had issued an order to report to 9.14-acres of prime land worth Rs 300 crore in Ameerpet in Hyderabad, for certain private entities to build a shopping complex.Rosaiah is one of the 13 accused in the case, that was presented by Mohan Lal, a defender. The petitioner alleged that the action of prime minister in the de-notification of land belonging to the Metropolitan Development Authority Hyderabad (HMDA) in favor of some private party caused a loss of Rs.200 crore for state treasury.
In the direction of the court, the ACB after a preliminary investigation, presented the report in March 2011. The report sought to give a clean Rosaiah it on the ground that there was no evidence against him. Also asked the court to dismiss the case.
In rejecting the report, the tribunal to question witnesses, including three senior IAS officers - CVSK Sarma, who was then prime minister's principal secretary, TS Appa Rao, then principal secretary of the department of municipal administration and urban development and BP Acharya, then Commissioner of HMDA. The three recorded their statements. Sarma identified the signature of the then minister boss in the file in question.
