NEW DELHI: The Supreme Court on Thursday issued notice to Kerala government on a petition filed by former Chief Minister VS Achuthanandan accused the regime headed by Congress to force the police to suppress evidence found during the investigation to save the influential politicians in the ice cream parlor sex scandal.
A bench of judges GS Singhvi and SJ Mukhopadhaya set aside the objection of the government of Kerala in search of an ex-CM copy of the report of steps taken in a sealed envelope presented to the Supreme Court, which is overseeing the investigation.
The bank said that the petition presented to the "values of unfathomable rapid change of life" and asked the State to file its reply within four weeks.
The state attorney said the petition had become infructuous as the police had presented a list of charges in the case and that the petitioner was entitled to a copy of it.
But counsel Shekhar Naphade of Achuthanandan said his client does not take it as a contentious issue and just wanted to highlight how young women were exploited by influential people, of which 25 were now occupying high positions in state government. He said that even after filing the charge sheet, the case should be supervised by a constitutional court.
The bench said: "You (Achuthanandan) have been representative of a people for years and therefore entitled to espouse the cause ... We appreciate the case public, but limited resources are keeping their hands tied."
Naphade said that a copy of the sealed cover action taken by Achuthanandan was sought for the sole purpose of helping the HC, which had decided to pursue the case, but had refused to participate with a copy of the report.
In August 1997, "Women's Counseling Center Anweshi" a social organization had filed a complaint alleging that an ice cream shop is running as a brothel in Kozhikode Nadakkavu area where women were being exploited by influential people.
In his petition, Achuthanandan said that while this Minister PK Kunhalikutty and his brother-in-law KA Rauf were allegedly involved in the sex scandal, both allegedly had paid enormous sums of money to the victims to buy their silence. "Although crime against these two people were recorded as early as January 30, 2011 and February 3, 2011, and a special investigation team was formed, not worth mentioning the research was carried out" he said.
"The ostensible reason being the change of government that has taken place since May 2011 and Kunhalikutty become a cabinet minister to exercise considerable influence in government," he said.
