CHENNAI: Kavinaya was only 75 days old when his father, software engineer and his mother were fatally struck by a reckless truck carrying sand in Chennai. Now, some three years later, a city court has granted about 92 lakh rupees compensation. While Rs 50 lakh is kept in a nationalized bank name until he is 18 years, Rs 20.9 lakh grandparents each in compensation.
The father of Kavinaya Prathap Kumar (28) was working in Canada and had come to Chennai on a holiday of 10 days. Although Kavinaya was also on the bike with their parents, safely seated in the lap of her mother, she was thrown off the bike on the impact of the crisis in the plush locality of Indira Nagar on November 20, 2009. His parents died on the spot.

The judge also said there was no delay in filing the first information report, there is no contradiction between medical records and the FIR and the witness account was also consistent. The fact that the truck driver was negligent and that he was driving the vehicle in a reckless and negligent also been proven through witnesses, the judge said.
By age of the victims, their positions and the salary which had been the drawing, the court said that the loss suffered by the child, along with funeral expenses and loss of love and affection, made Rs 91.78 lakh. The amount, payable by ICICI Lombard General Insurance Company Ltd on behalf of the owner of the truck, Sheikh Mohammed, must be deposited in a nationalized bank in three months. Beneficiaries are also entitled to an interest rate of 7.5 percent annually from December 2009 when the claim is filed petitions in court, the judge said.
